Terms of Use

By using Athena you accept the terms below. If you don’t agree, don’t use the app.

1. What the app is

A notes and notebooks app for iPhone, iPad and Mac: notebooks, sections and pages as plain files, tables and formulas, audio notes, photos and document scans, text recognition, search, locked sections, import from other notes apps, and optional sync with your own cloud account.

2. Accuracy

Text recognition, transcription of recordings, translation, table formulas and import from other apps are produced automatically and may contain errors or lose formatting. Check the result before relying on it, especially amounts, dates and numbers. The app is not a medical, legal or financial advice service.

3. Your notes

• Your notes are yours and stay yours: we acquire no rights over them. You are responsible for having the right to store and share whatever you put in, especially when it concerns other people or copyrighted material.
• Sync is not a backup. If you delete or change something on one device, sync passes it on to the others. Keep your own copies of important notes. Athena keeps no backups.
• If you edit the same page from two devices at once or offline, conflicts may arise and you may have to choose which version to keep. Page “locks” and the trash exist for this, but they don’t guarantee that nothing will be lost.
• Deleting the app deletes what the app itself keeps on the device. What is in a folder you chose or in your cloud stays there.

4. Locked sections

• The content of the pages of a locked section is encrypted with a password you set. The password is not stored and cannot be recovered. If you forget it, the pages will never open again, not even for us.
• Encryption protects the content of the pages. File names and the folder structure may be visible to anyone with access to the folder.
• Face ID or Touch ID is only a shortcut on one device; it does not replace the password. If you change the device’s biometrics, the password will be needed.

5. Cloud and third-party services

• Sync uses your own pCloud or Dropbox account. The terms and policy of each service apply; we don’t control them and aren’t responsible for them (availability, storage space, cost, loss or deletion of files by the service).
• YouTube, Vimeo and Dailymotion videos shown inside pages are loaded from those services and governed by their own terms. They may be unavailable or stop playing, and we cannot prevent that.

6. Permitted use

You may use the app for your personal or professional use. You may not:

• reverse engineer, decompile or modify it,
• use it in a way that violates the law or the rights of others.

7. Copyright and third-party licences

The code, design, graphics and texts of the app belong to Christos Dimakis. Text recognition uses Tesseract OCR and its language files (Apache 2.0 licence) through SwiftyTesseract (MIT licence). The search database uses GRDB.swift (MIT licence) and SQLite.

8. Purchases

Purchases inside the app, where available, are made through the App Store and governed by Apple’s terms. You request refunds from Apple.

9. No warranty

The app is provided “as is”, without warranties of any kind, express or implied. We do not guarantee that it will work uninterrupted or error-free, or that it will be compatible with every future version of iOS, iPadOS and macOS.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential damages, for loss of notes, files or data, or for harm caused by errors in text recognition, transcription, translation, formulas or import. Nothing in these terms limits the rights that consumer protection law gives you, or excludes liability for wilful misconduct or gross negligence.

11. Governing law

These terms are governed by Greek law. As a consumer you keep the right to bring proceedings in the courts of your place of residence.

12. App Store

Distribution is through the App Store and is also subject to Apple’s Terms. Apple is not responsible for the app and has no obligation to provide support.
